Who is eligible?
The right to personal assistance provided by a personal assistant is granted to a person with physical, intellectual, or mental impairment who has been assessed as having a third or fourth degree of disability severity. This includes individuals with functional impairments as defined by relevant assessment regulations and methodologies, who are 18 years of age or older and have the status of a person with disability in accordance with the law governing the Registry of Persons with Disabilities.

Barriers to obtaining the right to the service.
The right to personal assistance provided by a personal assistant cannot be granted to a person;

who is receiving in-home assistance based on the law governing social welfare or other regulations;

who is accommodated in a social welfare institution, with other service providers, in a healthcare or other institution, or in organized housing under the social welfare law or other regulations;

whose parent or another family member has been granted the status of parent caregiver or caregiver under the law on social welfare—except in cases specified in Article 34, paragraphs 4, 5, and 6 of the Personal Assistance Act;

who is entitled to a caregiver under other legal provisions;

who is in pre-trial detention or serving a prison sentence.

Procedure for obtaining the right.
Required documents to submit with the application:

A copy of the Findings and Opinion issued by the Institute for Expertise, Professional Rehabilitation and Employment of Persons with Disabilities. If you do not have this document or your condition has worsened since the last evaluation, the Social Welfare Center will refer you for a new assessment.

Barthel Index – obtained from a physiatrist or neurologist. Most health centers have specialist outpatient clinics where waiting times are usually short.
The Social Welfare Center you submitted your application to will invite you to appear before a commission that will determine how many hours of personal assistance you are entitled to. The number of hours granted primarily depends on the degree of disability (Level III or IV) and your Barthel Index score. We advise all potential users not to overestimate their capabilities when obtaining the Barthel Index, to avoid being granted fewer hours than needed.
When appearing before the commission, you must state the chosen provider of personal assistance services. We would be honored if you place your trust in us. For this purpose, you will need the Service Provision Agreement that AsistentOS d.o.o. has signed with the Ministry of Labour, Pension System, Family and Social Policy. Contact us and we will provide it to you before the commission date.
The decision granting the right to personal assistance is usually effective from the first day of the month following the issuance date. From that day, the personal assistant may be employed, and the applicant officially becomes a beneficiary of the service.
Selecting a Personal Assistant.
We advise all potential users of the personal assistance service to find and choose their personal assistant themselves. Such assistance is the best and highest quality, and misunderstandings or conflicts occur least often in these cases. AsistentOS d.o.o. can mediate in finding and assist with selecting a personal assistant.
Contract with the Personal Assistant.
The personal assistant enters into an employment contract with the service provider AsistentOS d.o.o. for an indefinite period, with a probationary period of 3 months. Before the expiration of this period, the user can decide whether the personal assistant meets their needs or if they want to find another one. After this period, the employment contract with the personal assistant can only be unilaterally terminated if they have seriously violated its terms, and only after 3 written warnings.
